Terms and Conditions
These Terms and Conditions set out the basis on which Chevron Equipment Finance, ABN 58 119 232 825, PO Box 536, Varsity Lakes, QLD, 4227, (we, us, CEF) will provide the services to you, your obligations to us and the facts on which we both rely upon to enter into this agreement.
By applying for a loan through us you agree that you have read and agree to be bound by the terms and conditions listed below.
Services offered
We act as finance brokers on behalf of lenders, predominantly for equipment finance products. We will provide you with information regarding the type and availability of credit contracts, finance products and loans. We will also assist you in the application for finance by arranging offers to be made to you by lenders.
We do not advise you on the legal or financial implications of entering into credit arrangements or particular finance products.
Our panel of lenders
We have entered into arrangements with the lenders which allow us to obtain credit for you from these lenders subject to you meeting the lenders credit criteria. The lenders with which we have arrangements do not necessarily represent all the lenders who offer credit of the nature that you seek. We can consider entering into agreements with lenders that are not part of our standard panel providing they deal with brokers and consent to our accreditation.
Fees payable by you
We are paid by the lender for doing the work that would otherwise be completed by a lender or bank manager. We will charge you a documentation fee for preparation of your documents on behalf of the lender and may also charge other fees including a fee to conduct a private sale transaction where applicable.
For some types of loans such as commercial loans, short term loans or loans where we will not earn industry standard commissions or have our commissions clawed back by the lender then we may charge you a brokerage fee.
In all cases, any fees charged by us will be disclosed to you up front.
In some situations, we may charge a processing fee of 2% + GST of the proposed amount financed for work completed if you have dealt with us in an unethical manner, or you have been approved for the finance you sought and decide not to proceed.
Refund policy
Any fee paid by you is non refundable.
Compliments & complaints

We endeavour to handle your feedback in house via our Director or Complaints Manager.
In the event that a complaint you lodge with us is unable to be resolved you may refer your complaint to the Credit Ombudsman Service Limited, who are our appointed External Dispute Resolution scheme.
You may contact them only after you have been unsuccessful in coming to an agreement to us regarding your complaint. Their contact details are:

How will my complaint be handled?
One of our Managers will record the complaint on our register, investigate the complaint by discussing the matter with our staff, and then call the customer to further clarify their complaint.
Once sufficient information has been gathered, a decision is made on what action to take and, if necessary, compensation may be paid to the customer.
Once action has been taken, our Managers will analyse the cause of the complaint and discuss any required changes to our systems / procedures with the Director and/or Operations Manager.
The register is then updated with the outcome and the complaint file is closed.
We confirm that:
We do not determine or recommend the conditions of the credit contract (such as interest rates, fees or the term of the loan);
We and nobody else will receive any financial or other benefit or have any other interest or relationship which could reasonably be expected to influence our recommendation other than as disclosed in the brokerage agreement; and
You acknowledge and agree that:
You agree to engage us to arrange the loan described above on your behalf.
The information you have provided to us is true and correct and that we will rely upon such information in arranging for the loan on your behalf.
You understand that we are not qualified to give legal or financial advice and any information we give you is of a general nature only and is not specific for your situation. We recommend you obtain your own legal and financial advice regarding the suitability of the loan to your needs or purposes. In entering into this agreement you expressly agree and represent to us that you have relied upon your own independent inquiries and advice in relation to the financial and legal implications of entering into this agreement or a loan contract.
You will release us, indemnify us and hold us harmless from all and any loss, damage, cost or injury suffered by you, and with respect to any claim, proceeding, or action which does or might arise out or in relation to this agreement or the services provided to you by us.
The terms of the loan you are seeking are indicative only and may be subject to change. Please refer to the loan contract given to you by the lender for the full terms and conditions of the loan.
You are able to make the quoted repayments over the quoted term without undue hardship.
If your loan is a “Low Doc” loan then the income being declared by you is true and correct.
In dealing with us, you agree to be bound by these terms and conditions.

• Communication between you and CEF, finance service providers, and where applicable your employers and credit agencies.
• Some telephone conversations which may be recorded from time to time for quality and training purposes.
If you are applying for finance we may also be required by the financiers to collect some personal information regarding your dependents, including number and ages of dependents, as well as cohabitants, their relationship to you and the length of time they have cohabitated at your current address.
How your personal information will be used
We collect your personal information so that we can use it for our functions and activities which include, amongst other things:
• Assisting you with your finance requirements;
• To keep you informed of our products and services and any changes to our organisation;
• To facilitate contact with you;
• Confirming your identity (eg. when you wish to use our products or services);
• Addressing any feedback or complaints or queries you may have;
• Any purposes for which it was requested and directly related purposes, monitoring and developing, improving and marketing our products and services; and
• To comply with any mandatory requirement of law.
Disclosure of Personal Information to third parties
The organisations we may disclose your personal information to include:
• Finance providers or other intermediaries as part of assisting you with your financial requirements;
• Anybody who represents you including financiers, brokers, lawyers and accountants;
• Your past and current employers, referees, identity verification services;
• Our related companies, business associates and others for purposes directly related to the purpose for which the personal information is collected;
• Organisations involved in any possible future transfer/sale of all or part of our assets or business;
• To our professional advisors, relevant contractors and service providers;
• Our national cloud storage and IT service providers;
• Others that you have been informed of at the time any personal information is collected from you;
• To any entity to which we are required or authorised by or under law to disclose such information.
Direct Marketing
From time to time we may use your personal information to provide you with current financial information, any changes to CEF, new product offers by CEF or any company with whom we are associated. We may from time to time use third party businesses to assist us in managing your account for these purposes.

We will not charge you for giving effect to that request and will take all reasonable steps to meet your request at the earliest possible convenience.
